Welcome to Sukhaboat, a boat rental platform for private individuals. By using our website and services, you agree to comply with these Terms and Conditions. If you do not agree with any of the terms set out here, we recommend that you do not use our services.

2. Definitions

Marketplace: Refers to Sukhaboat, the boat rental platform.
User: Any person who browses, registers, or uses the marketplace services.
Owner: A person who owns and lists a boat on the marketplace for rent.
Renter: A person who rents a boat through the marketplace.
Services: All services provided by Sukhaboat, including the website and mobile application.

3. Use of the Platform

Users must be at least 18 years old to register and use the platform.
Owners must provide accurate and complete information about the boats they list, including photos, descriptions, availability, prices, and any other relevant details.
Renters are responsible for providing truthful information when making reservations and for complying with all applicable legal and licensing requirements to operate the boats.

4. Registration and User Accounts

To use certain marketplace services, users must create an account by providing accurate and up-to-date personal information.
Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.
Sukhaboat reserves the right to suspend or terminate accounts in case of suspicious activity or violation of these terms.

5. Boat Listings and Owner Obligations

Owners must ensure that all listed boats are in good condition and comply with local safety and maintenance regulations.
Owners are responsible for the accuracy of the information provided about their boats and for updating it as necessary.
Owners agree not to offer a boat on the marketplace that they do not have the legal right to rent.

6. Reservations and Payments

Renters can reserve boats through the marketplace using the online booking system.
Payments are securely processed through the platform. Various payment methods are accepted, such as credit and debit cards.
Owners will receive payments for reservations minus the marketplace’s commission, as agreed upon at the time the boat is listed.
Any applicable fees or local taxes will be the responsibility of the owner or the renter, as appropriate.

7. Cancellations and Refunds

Cancellation and refund policies are determined by each owner and will be clearly stated on each boat’s listing page.
Renters should review the specific cancellation policy before making a reservation.
Sukhaboat is not responsible for refunds or disputes between owners and renters, although it may mediate in exceptional situations.

8. Insurance and Liability

Sukhaboat recommends that all owners have adequate insurance covering the rental of their boats.
Renters should also consider obtaining insurance for their personal protection and the protection of the boat occupants during the rental.
Sukhaboat is not liable for any damage, loss, or accidents that occur during the rental of boats. Owners and renters agree to hold Sukhaboat harmless from any legal liability in such cases.

9. User Conduct

All users must behave respectfully and professionally during interactions through the platform.
Illegal, fraudulent, or conduct that violates these terms and conditions will not be tolerated.
Sukhaboat reserves the right to investigate and take action, including suspending or terminating accounts, against any user who violates these terms.

10. Exchange of Personal Data

Exchange of Personal Data between Users and Sellers: To ensure security and privacy in transactions within the platform, users and sellers are prohibited from exchanging personal data (such as phone numbers, email addresses, physical addresses, or any other contact information) through the platform’s internal messaging system until the reservation is confirmed. The company reserves the right to review messages to ensure compliance with these conditions and to guarantee the proper use of the platform. Additionally, the administrator may intervene in conversations, replying on behalf of the company if deemed necessary. Any attempt to share such information prior to confirmation may result in temporary or permanent suspension of the account.

11. Limitation of Liability

Sukhaboat does not guarantee the continuous availability or error-free operation of the platform.
Under no circumstances shall Sukhaboat be liable for direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services.

12. Changes to the Terms and Conditions

Sukhaboat reserves the right to modify these Terms and Conditions at any time. Modifications will become effective at the time of publication on the platform.
Continued use of the platform after any changes implies acceptance of the new terms.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.
Any dispute arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Illes Balears/Spain.
